Terms of Service

1. Acceptance of terms

By accessing or using NSS Background Remover (“the Service”) at bgremover.novusstreamsolutions.com, you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users of the Service.

2. Description of service

NSS Background Remover is a free, browser-based platform for removing backgrounds from images (with AI), a full image editor for refining those cut-outs, an AI image upscaler, a video editor, and a suite of client-side image and video utilities. It also includes model-backed tools for restoration, object removal and replacement, privacy assistance, smart cropping, captioning, and transcription. All media processing occurs locally in your browser — no files are uploaded to any server. The Service is provided by Novus Stream Solutions (“we,” “us”), Ontario, Canada.

The Service is supported by advertising revenue through Adsterra. To keep the tools free, display, native, rail, and Social Bar ads load on eligible public pages, and an export may open a sponsor page in a new tab. Legal, consent, and full editor workspaces remain ad-free. Adsterra and its advertising partners may use cookies to serve and measure ads; you can manage preferences via “Manage cookies” in the footer and at aboutads.info. See our Privacy Policy and Cookie Policy for details. The Service is currently offered without a use fee, subject to the file, queue, device, browser, and availability limits disclosed in the product. This may change under Section 2a, with advance notice of a material change where reasonably practicable.

Advertising is blocked until opt-in in consent-required regions; in open regions it is eligible by default unless the user has declined. Global Privacy Control overrides either state.

The editors and tools are one-time-use: we do not provide accounts, cloud storage, or any means of saving your work on our servers. Anything you create exists only in your browser until you download it or close the tab. You are solely responsible for saving your exported files.

2a. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service is provided on a best-effort basis with no uptime SLA or availability guarantee. We may suspend the Service or any part thereof for maintenance, security, or any other reason without notice.

Most managed AI model weights are hosted on immutable Hugging Face URLs; some weights are served from this site or through the optional WebLLM runtime. Availability of those downloads can therefore depend on third-party infrastructure outside our control. If a model cannot be downloaded, the relevant tool falls back to its non-model path where it has one, and otherwise reports that it cannot run. We are not responsible for downtime or degraded performance of third-party services.

Large add-on models download only after the permission shown for that model. Other local assets load only after an explicit feature action, such as selecting a background-quality mode or pressing Build AI mask, Detect, or Suggest framing. Declining is supported where a manual or classical path exists; a tool with no honest fallback reports that it cannot run and leaves the media unchanged.

The central disclosure currently covers 15 model-powered processing paths, including the separate opt-in WebLLM assistant. See the Privacy Policy for sizes, consent behaviour, and fallbacks.

We reserve the right to discontinue, modify, or retire any feature or tool at any time. We will endeavour to provide advance notice of major changes at /changelog.

2b. AI output liability

AI background removal, upscaling, and all other AI-powered features on this Service produce probabilistic results. Output may contain errors, artefacts, omissions, or unintended modifications. Specifically:

• Background removal may incorrectly remove foreground subject pixels or retain background pixels
• Upscaled images are enhanced estimates, not ground-truth high-resolution captures
• Video processing results may differ from the original in colour, timing, or quality
• Face restoration does not recover the original pixels — it generates a plausible face consistent with what survives in the photograph. On a badly degraded image it will still produce a crisp, confident face that may differ from the person. Do not use a restored face for identification, and keep the original file
• Deblurring can only undo a predictable spreading of light. Heavy motion or a badly missed focus has lost information no model recovers; a sharper-looking result is not a recovered one
• Generated captions and alt text describe what the model recognises, not what matters in the context of your page. Treat every caption as a draft to be edited
• Generative tools (text-to-image, inpaint, style transfer) and analysis tools (captioning, tagging, OCR) produce synthetic or estimated output that may be inaccurate, biased, or unintentionally similar to existing works

You are solely responsible for reviewing all AI-processed and AI-generated output before use, and for ensuring that any content you create with the generative tools does not infringe third-party rights or violate applicable law. We make no warranty that AI output is suitable for any particular purpose, including commercial use, publication, or legal/compliance review. Do not rely on AI output without independent verification.

2c. Bring-your-own AI models (BYO ONNX)

Some processing paths will use a model URL you have configured yourself (“bring-your-own ONNX”) in place of the model we curate. Where one is configured in your browser, your browser downloads and runs that model directly from the host you specify — we do not host, vet, proxy, or have any access to it.

• You are solely responsible for the licence, legality, safety, and suitability of any model you load
• You must have the right to use the model under its licence terms for your intended purpose
• We disclaim all liability for output, errors, or harm arising from a model you supply
• A bring-your-own model runs entirely on your device under the same client-side architecture — your files still never reach our servers

3. Acceptable use

You agree not to use the Service to:

• Process images of minors in a manner that is inappropriate, exploitative, or illegal
• Create or distribute non-consensual intimate imagery
• Generate, with the AI generative tools, content that is illegal, deceptive (e.g. impersonation or misleading deepfakes), infringing, or designed to deceive or harm others
• Load a bring-your-own model you are not licensed to use, or one designed to produce unlawful content
• Attempt to reverse-engineer, decompile, or extract the AI models beyond what is permitted by their respective licenses. The background-removal models are ORMBG (Apache-2.0) and BiRefNet (MIT); every other model the Service downloads is a third-party release governed by whatever licence its publisher sets
• Use automated scripts to scrape, stress-test, or abuse the Service
• Circumvent any security measures
• Use the Service in any manner that violates applicable law

We reserve the right to block access for violations of this section.

4. Intellectual property

Your content: You retain all rights to the images and videos you process using the Service. By using the Service, you do not grant us any license to your files. As described in the Privacy Policy, your files never reach our servers.

Our content: The Service interface, written content, and code are owned by Novus Stream Solutions unless otherwise noted. The AI models are not ours: each one is a third-party open-source release your browser downloads from Hugging Face, subject to its own licence.

Output: As between you and us, we claim no ownership interest in files you export from the Service. Any copyright or other rights in an output depend on your source content, applicable law, and third-party rights or licences; these Terms do not create rights you would not otherwise have.

5. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any AI processing will produce any particular result. AI models may produce imperfect output. You are responsible for reviewing all exports before use.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOVUS STREAM SOLUTIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) CAD $10.00.

6a. Indemnification

You agree to indemnify, defend, and hold harmless Novus Stream Solutions and its employees, contractors, service providers, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property rights; or (d) any content you process using the Service that infringes, misappropriates, or violates any law or the rights of any third party.

We reserve the right to assume exclusive control of any matter subject to indemnification by you. You agree to cooperate fully with our defence of any such claim.

6b. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including (without limitation) violation of these Terms. Upon termination: (a) all rights granted to you under these Terms immediately cease; (b) you must stop using the Service.

Because the Service stores no account or user data on our servers, “termination” for most purposes means blocking your access at the network level. Any locally cached data (model weights, preferences) remains in your browser and may be cleared by you at any time via browser settings.

You may stop using the Service at any time. Sections 4, 5, 6, 6a, 8, and 9 survive termination.

7. Third-party content

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third party. Links do not constitute endorsement.

8. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You irrevocably consent to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute arising from these Terms.

9. Changes to terms

We may update these Terms from time to time. We will update the “Last updated” date at the top of this page. Material changes will be announced on the homepage. Continued use of the Service after changes constitutes acceptance of the updated Terms.
